these days its become a fashion that if the patient pass away even in spite of best efforts of the doctor even in that scenario the relatives and friends of the patient attack doctors, start rioting in the hospital premises in spite of being aware that other patients will get effected badly.
The general public seems to be unaware about the law that safeguards a medical practitioner. Section 88 of the Indian Penal Code lays down that an act not intended to cause death, done by consent in good faith for person’s benefit, does not constitute an offence. In simple words, police action should not be initiated against a doctor in suspected cases of medical negligence. Instead, the investigating officer is required to forward the case diary along with a post-mortem report, if any, to a team of doctors of the Medical Council of India (MCI) for probe.
